On July 16, 2013, at approximately 3:07 a.m., Rincon District deputies responded to the Giant Gas Station in the 6800 block of East Sunrise Drive, reference an assault with a deadly weapon call. When deputies arrived, they learned from the clerk that two males entered the store wearing bullet proof vests and appeared to be very intoxicated. During the sales transaction, one of the men pulled out a handgun and pointed it at the clerk. He was told by the other man to put the gun away but the first subject pointed the gun at the clerk a second time. The men left on foot prior to the arrival of the deputies. A coordinated search of the area was immediately started and the men were located shortly after at a nearby apartment complex. Detectives with the Sheriff’s Robbery Assault unit were called to the scene and took over the investigation. During the course of their investigation, detectives learned that the suspect never demanded anything while pointing the gun at the clerk. The clerk, who feared for his life during the incident, was able to provide a good description of the suspects. The man who pointed the gun at the clerk was later identified as 23-year-old, off-duty Tucson Police Department Officer Kyle James McCartin. McCartin has been booked into the Pima County Adult Detention Center charged with two counts of Aggravated Assault.
